Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the http://www.AUSSPEED.COM.AU website (the “Service”) operated by AUSSPEED (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. ABOUT THE SERVICE.

1.1 The AUSSPEED is AUSTRAC registered (Australian Transaction Reports and Analysis Centre), with Registration No.IND100358640-001.
1.2 AUSSPEED provides money transfer services internationally to Philippines from Australia. You must be of majority age to use AUSSPEED service. Each remittance will be given a unique transaction code as identifier. Money transfers will normally be released in cash, or be transferred to a bank account.
1.3 To facilitate the transaction, AUSSPEED will require personal information and other legal documents.
1.4 For collection of the transferred money, receivers must show documents of their identity and details about the transaction required by bank or money forwarders. On occasion, additional identification and other information may be required from the customer.

1.5 Service fees: Information of service fees and charges are made visibly available to the Sender prior to completion of the payment order. Unless applicable law in the destination country requires otherwise, the Sender will bear all fees for the money transfer. In certain cases, payment of a money transfer may be subject to local taxes and service charges. For account based money transfer, the Receiver may incur additional fees for receiving the Sender’s funds through a mobile telephone or to an account. Transfers should be sent to a local (Receiver) currency account, otherwise the receiving institution may convert the funds at its own exchange rate or reject the transaction. AUSSPEED accepts no responsibility to the Sender nor to any account holder for any fees, exchange rates used for conversion to non-local currency, acts or omissions of the destination or intermediary financial service providers.

2. OUR RESPONSIBILITY TO YOU.

2.1 AUSSPEED will provide you with a safe reliable money transfer service.
2.2 We will generally rely without further enquiry on information that you provided through the website, email, or phone and actually received by us, unless we have actual notice that any such message is incorrect, unauthorised or forged.
2.3 We do not accept any responsibility to you for:
(a) the goods or services which you pay for by using AUSSPEED. We advise that you take precautionary measures in dealing with online seller that you do not know;
(b) problems in communications facilities which are not under our control that may affect the information you send to us;
(d) the services provided to you by your card issuer;
(e) viruses caused by third parties;
(f) errors on the Site caused by incomplete or incorrect information provided to us by you or a third party;
(g) any unauthorised use or interception of any information before it reaches the Site; or and the contractual relationship between us does not extend to the benefit of the Receiver and the Receiver does not have an independent right to demand payment.

2.4 AUSSPEED has the right to refuse to accept certain transaction that is against the AUSTRAC policy. If we do so, we will provide proper notification.

2.5 We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. We will notify you of any change to our Terms and Conditions by posting a clear and readily accessible notice of change on the AUSSPEED website.

3. YOUR RESPONSIBILITY TO US.

3.1 You agree to pay the appropriate fee for every service that you request from AUSSPEED. Information about our services and corresponding price fees is visibly available in our website.

3.2 You acknowledge and agree that:
(a) when you register with us, you will provide us with true, accurate, current and complete information;
(b) you will maintain and promptly update such information to keep it true, accurate, current and complete;
(c) you will not use the AUSSPEED for or in connection with any prohibited purpose;

3.4 You acknowledge and agree that information about you, and the services we provide to you, may be provided by us from time to time to regulatory or governmental authorities, bodies or agencies where:
(a) we are required by law to do so; or
(b) if we determine that such disclosure may help to combat fraud, money laundering offences or other criminal activity.

4. CANCELLATION, REFUNDS AND ADMINISTRATIVE CHARGES.

4.1 A sender must send a written request of cancellation of remittance transaction by sending it through email or to our address indicated in Contact Us page.

4.2 Request for refunds for cancelled transaction can only be granted when the money is not yet delivered to the receiver. AUSSPEED will refund only the principal amount of a money transfer upon the Sender’s written request.

5. REGISTRATION

You are required to register with us in order to use the AUSSPEED Remittance service. Registration is subject to these Terms and Conditions.

6. DATA PROTECTION

AUSSPEED is committed in protecting your privacy. We will not sell, share, or rent your personal information to any third-party.

AUSSPEED collects personal and other relevant information from the registration form, and transaction activities you made with us. This information will be used to provide you with the future services you will ask for and for activities such as administration, customer service, anti-money laundering, compliance and legal duties, validate your details, to help prevent and detect fraud, debt and theft, to help us improve our products, services and operations, and, subject to your choices, send you commercial communications by email, telephone, post, SMS and by any other relevant channel.

AUSSPEED may also use, collect from and share with other businesses that work with us. This information may be used for any of these purposes in this section. We will hold and retain the information that you give us about another person including the details of the receiver of our services in order to execute the transaction. Prior to providing this information you are obliged to notify and secure authorisation from the other person on our use of this information as set out in this section. The provision of this information is optional information, but needed to execute the transaction and provide these services to you. Without it, AUSSPEED is unable to provide the money transfer, facilitate convenience activities or other requested services.

CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If AUSSPEED is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to serve you.
